In Flamborough/Hamilton, open-air burning (OAB) is only allowed in areas that have been designated as rural, and it must adhere to the Open Air Burning Guidelines. Residents living in urban areas are not permitted to conduct open-air burning.
Anyone that has concerns about OAB (regarding the size of the fire or pile, smoke migration, contents of the fire, burn permit validity or purchase etc.) can contact the Hamilton Fire Department’s non-emergency number at 905-546-3333 option #5 for assistance.Crews will respond to the property (without lights or sirens), extinguish the fire if necessary and collect any applicable information to support the actions that are taken while on site. A further review of the incident will be conducted by Fire Prevention which will determine it a violation of the OAB By-Law was committed. Property owners that are found to be in violation of the OAB By-Law may be subject to the following costs:
- $526.90 per hour for each responding vehicle for the first hour and
- $263.45 per half hour for each responding vehicle thereafter.
In addition, the Hamilton Fire Department reserves the right to revoke the burn permit and proceed with prosecution for contravening the OAB By-law where necessary.
